Hi; ihad writen before , i bought a clone computewr that didnt bring a
recovery disk, so i went and bought a new windows xp pro w/ sp2 software
wicth is what i have in my computer, my question is it brought a medium size
chip or hardware as they call it do i have to install this hardware and is
there anything i have to do to install the sftware, like cleaning the drive
or something. Please help. Thank you John A.

You don't. You boot from the CD and from there you can re-format the hard
disk prior to installing your new version...

Now it starts to become a little clearer! It would appear that you've
gambled on getting legitmate software on eBay and been rewarded with an
OEM (Original Equipment Manufacturer) installation CD, accompanied by a
piece of hardware. (The fact that this hardware, based on your
description, doesn't truly qualify for an OEM license isn't your fault;
it's the seller who may be committing fraud.

Correct. An OEM installation CD can either perform a clean
installation, or repair another, salvageable installation. The latter
option does not work, so you'll have to perform the clean installation.
After backing up any data you wish to transfer to the new OS
installation, simply boot from the WinXP installation CD. You'll be
offered the opportunity to delete, create, and format partitions as part
of the installation process. (You may need to re-arrange the order of
boot devices in the PC's BIOS to boot from the CD.)

You don't have *what* disk? You've just said that you bought one from
eBay. No other disk should be needed, as all legitimate WinXP
installation CDs are bootable.

No, that was just the seller's attempt to make the sale of an OEM
license legitimate, or to as least seem that way. OEM versions must be
sold with a piece of non-peripheral hardware (normally a motherboard,
RAM modules, or a hard drive) if not an entire PC.

Well you still have answered all my questions, but I think there's
enough info that I can make intelligent guesses as to what's going on.
Ignore the hardware, or throw it away. You presumably bought an OEM
copy (which I never recommend), and that requires that you get
hardware with it; they sent that to make it legal, as Gordon
suggested. You don't need it.

You still have not explained exactly *how*, but from the rest of this
sentence, I'll guess that you tried to install it from within Windows.

Yes, you do have it. It's the Windows CD itself.
You can't format the Windows drive from within Windows, since that
would leave Windows without a leg to stand on.
Just boot from the Windows XP CD (change the BIOS boot order if
necessary to accomplish this) and follow the prompts for a clean
installation (delete the existing partition by pressing "D" when
prompted, then create a new one).

So if it was an OEM version purchased with qualifying hardware, and from
I've seen in the EULA, doesn't that qualifying hardware have to become
incorporated into the computer in which the OP wants to use that OEM
version of Windows? Would've been better if the OP had purchased a
drive cable to put inside the box so the license for Windows went with
it. Obviously the OP can just toss the chip and just install the OEM
version of Windows.

The qualifying hardware is supposed to be purchased first (or first in
consideration) and the Windows license goes with it. Supposedly that
qualifying hardware gets used in your computer so the accompanying
Windows license gets incorporated into the computer. However, what
probably happened is that you never did specify what qualifying hardware
to get (that you could actually use) and the seller just grab something
out of some scrap bin to include under the guise of qualifying hardware.
At this point, just toss the qualifying hardware. There's a good chance
that it won't work even if it does fit into your computer.
Since you bought it on eBay and if it wasn't too long ago, what is the
URL to the auction? Further replies would be better focused if those
you ask actually could see what got sold.

Sure looks like the [qualifying] HARDWARE used to purchase the OEM
version of Windows must be *in* the COMPUTER in which that HARDWARE
operates. A drive cable or chip with the license of Windows won't be
running that copy of Windows all by itself. The qualifying hardware is
supposed to get put into the computer in which Windows will then
function. In addition, and was pointed out by another MVP:
"The SOFTWARE is licensed with the COMPUTER as a single integrated
product and may only be used with the COMPUTER."
Before I read that, I figured the Windows licensed remain tied to the
qualifying hardware which meant that I could move that license of
Windows to another box (i.e., wipe from one box and install on another
as long as the qualifying hardware moved, too). I had thought the
license wouldn't get usurped by the computer once the qualifying
hardware, as the system component, got installed in a computer. The
above means the license does move from the qualifying hardware to the
COMPUTER (which, again, the definition of which is *with* the qualifying
hardware installed into that computer).
Yeah, the OP must install the chip per the license requirement but
obviously probably shouldn't. It's probably non-working junk. It isn't
the buyer's fault that the seller defrauded their OEM reseller contract
with Microsoft.

So rephrase the 1st paragraph to get rid of all the commas to eliminate
pending clauses along with focusing on just the qualifying HARDWARE used
to get the OEM license:
"If the HARDWARE is a computer system component then the term COMPUTER
shall mean the computer system in which the HARDWARE operates".
The qualifying hardware is the system component; i.e., the hardware is
supposed to go into the computer in which the license of Windows get
used. Hardware that sits disconnected while sitting in a drawer
somewhere is not a system component of the COMPUTER. In the other
paragraph of:
"The SOFTWARE is licensed with the COMPUTER as a single integrated
product and may only be used with the COMPUTER."
the "as a single integrated product" applies against COMPUTER, not
SOFTWARE.

I agree with your reading of the EULA, but I somehow doubt the eBay
seller has any sort of reseller contract with Microsoft....

Well, I've read both your message and Vanguard's subsequent one, and I
still don't agree.
However I think it makes very little practical difference, and it's not
worth arguing about. That goes double today, because I'm on vacation this
week and have very little time for newsgroups. So I'll bow out of this

It sounds like you purchased an OEM version of XP. OEM (Original Equipment
Manufacturer) versions are essentially a version of Windows that a
manufacturer has made a Licensing agreement with Microsoft to sell under
special conditions. In some cases OEM's are sold preinstalled on systems
like Dell or Compaq. In other cases OEMs are sold with a piece of hardware.
Like it appears you have. The short answer to your question is no you do not
"have to install the hardware." However once you've install the OEM version
on your computer it is tied to your computer and can not be resold unless
you are selling the whole computer.
